Hourly Fee Agreements
This is one of the most common arrangements we have with our clients. You pay
for the time we spend working on your file only. The hourly rate is negotiable
and depends upon the complexity of the assignment and the extent of our involvement.
Generally, we require a retainer fee to be deposited into our State Bar Client
Trust Account for your benefit and it remains there until earned and credited
to your account against the fees or costs that you may owe. The specifics
about how the retainer fee is credited to your account are set forth in a
document called the Retainer Agreement which we urge you to review carefully
before signing and returning.
Contingency Fee Agreements
These agreements are quite rare for our firm however in the right circumstances
we will consider taking a matter on a contingency fee arrangement. This is
an arrangement where there is no fee paid by you per hour but instead your
costs and a pre-set percentage of your recovery is taken out of the proceeds
that we recover on your behalf. This works best in matters where there is
a certain monetary recovery to be had, typically as the result of some kind
of litigation or arbitration. In some litigation matters, it may still be
to your benefit to consider an hourly arrangement if you believe that the
other side will settle the matter early. You should consider the economics
of the situation before entering into this type of agreement.
Period Retainer Agreements
Since our relationships with the majority of our clients last many years and
have gone beyond any particular assignment orientation, many of our clients
have opted to keep InternetLitigators on a monthly retainer program. This
ensures our availability to you for the regular, common, ordinary questions
or assignments that come up in the management of any business. Generally
you are billed a standard fee each month. In return, you are given both a
credit for a guaranteed number of hours that you will pay for during that
month. In addition, you will typically receive a more favorable hourly fee.
Depending upon the number of hours that you guarantee each month you may
also receive a reduced hourly rate on any hour that you use over your guaranteed
hours each month.
Creative Fee Agreements
Over the years we have also created fee agreements to meet a client's needs
in many other respects. In general, it is our policy not to accept any ownership
interest in a client. However, beyond that, we are always willing to consider
or suggest other options that may be appropriate in any given situation.
All of our fee agreements will be in writing and will clearly state the terms
of our agreement. Fee agreements whether hourly, contingency or retainer
are binding legal documents that should be read carefully and before signing.
If you have any questions about any attorney fee agreement you should ask
very specific questions until you are satisfied that you understand the answer
and that that that answer is reflected in the writing that you are going
to sign.
